Do you need permission for a garden room?

Most garden rooms don’t need planning permission. Whether you need planning permission for a garden room in the UK depends on several factors, including its size, height, location, and intended use.

Permitted Development Rules (No Planning Permission Needed)

A garden room is often permitted development, meaning you don’t need planning permission, provided it meets these conditions:

  • It is single-story.
  • The maximum eaves height is 2.5m, and the maximum overall height is 3m with a flat roof or 4m with a pitched roof.
  • It is not in front of the main house.
  • It is not larger than 50% of the total land around your house.
  • It is not intended for residential use (e.g. sleeping in it overnight).
  • If placed within 2m of a boundary, the maximum height must be 2.5m.
  • It is not in a listed building, conservation area, or AONB (Areas of Outstanding Natural Beauty).

 

When You Need Planning Permission

You will need planning permission if:

  • The garden room exceeds the size limits above.
  • You plan to live or sleep in it regularly.
  • Your property is listed or in a restricted area.
  • You want to build it as an independent dwelling.

How big can a garden building be without planning?

Under permitted development, a garden building can cover up to 50% of the total garden area and must not exceed 2.5m in height if within 2m of a boundary. If further away, it can be up to 3m with a flat roof or 4m with a pitched roof.

Can neighbours object to a garden room?

If it meets permitted development rules, neighbours can’t formally object. If planning permission is needed, they can raise objections based on privacy, noise, or light concerns.

Do you need to dig foundations for a garden room?

Most garden rooms need some form of base, but this could be ground screws, concrete slabs, or a full foundation depending on the design.

The type of foundation required depends on the size, weight, and intended use of the structure.

If your garden room is large or has plumbing, heavy furniture, or year-round use, you will need foundations. If it is a small, lightweight structure (under 2.5m high) and placed on a solid, level surface like paving stones, you won’t need foundations.

What is the 2.5m rule for garden rooms?

If the garden room is within 2m of a boundary, it must be no taller than 2.5m to avoid needing planning permission.

Do I have to pay council tax on a garden room?

No, unless it’s used as a separate living space. If it’s just for work or leisure, council tax doesn’t usually apply.

Can you sleep in a garden room in the UK?

Yes, you can sleep in a garden room in the UK, but certain rules and permissions apply:

  1. Occasional Use (Nap, Guest Room, etc.) – No Planning Permission Needed
  • If you use it as a spare room for occasional naps or guests, it may be allowed under permitted development.
  • However, it must still meet size and height limits (under 2.5m eaves height and 3-4m total height, depending on roof type).
  • It cannot be self-contained (no kitchen, bathroom, or independent living space).
  1. Full-Time Living or Sleeping Regularly – Planning Permission Needed
  • If you plan to sleep in it regularly or use it as a separate dwelling, you will probably need planning permission.
  • Building Regulations apply for insulation, ventilation, fire safety, and electrical work.
  • If the garden room has a bathroom, kitchen, or plumbing, it’s considered self-contained accommodation, requiring full approval.
  1. Renting It Out (Airbnb, Long-Term Rent) – Planning Permission Needed
  • If you intend to rent it out, it becomes a separate residence, needing full planning permission and building regulations approval.
